After reviewing the subdivision agreement, Prince Edward County has determined they are not obligated to provide garbage and recycling service to the Port Picton subdivision.
The findings of staff and legal counsel were presented to members of council during Thursday’s Committee of the Whole meeting.
Residents of the Port Picton community have previously asked the municipality to assume responsibility for picking up waste from the community, citing a clause in the subdivision agreement stating the municipality would take on that responsibility. Previously, garbage and recycle collection has been contracted out privately.
After a review of the agreement by municipal staff and lawyers, it was determined the clause in question referred to collection from waste bins on public parkland in the area, not for homes. The parkland in question was turned over to the municipality as public property.
During the meeting, a motion was put forward to establish waste management services for the subdivision, despite not being obligated to do so. The motion was defeated.
