The director of the province’s Special Investigations Unit has concluded a Kingston police officer did not commit a criminal offence during the arrest of a man last year.
The man was diagnosed with a fractured orbital bone after a struggle during his arrest on Christmas Day.
Police responding to a domestic dispute at an apartment building were met by the building superintendent who escorted officers to a unit but obstructed their entry into the apartment.
When an officer took hold of the superintendent’s arm to arrest him, he resisted and a struggle ensued.
He was taken to the floor and handcuffed behind the back.
He was later taken to hospital where he was diagnosed with a fractured right orbital bone.
On his assessment of the evidence, SIU Director Joseph Martino determined there were no reasonable grounds to believe that an officer committed a criminal offence in connection with the man’s arrest and injury.
