The City of Belleville’s Planning Advisory Committee received input from the public about a proposed additional dwelling unit to the building located at 363 Front Street.
The three-storey mixed-use building has commercial space on the ground floor and five dwelling units above the ground floor.
Cento Commercial Inc., the owners of the building, received a minor variance to grant parking relief to allow for a sixth dwelling unit.
The proposal brought to the committee calls for a seventh dwelling unit located on the ground floor of the building.
Tim Barnes, representing 2059759 Ontario Limited, a company owned by Mark Rashotte, objected to the proposal.
The company owns property nearby the site.
Barnes says the right of way between 363 Front Street and a building north of the property was owned by Rashotte’s company.
“The drawings that were submitted with it propose to have a new entrance constructed that would enter onto that right of way. So we object to that,” Barnes explained to the committee.
“The use of that right of way wasn’t intended to be a public or private entrance into an adjacent building.”
Barnes said the right of way was supposed to provide free access through the space.
A representative of Cento Commercial Inc. clarified that the company did have legal easement when it came to that right of way.
Andrei Pershin says the company had the legal documents to support that they have the easement.
Staff will provide a report to the committee at a future meeting.
