Legal issues will delay any decision from Prince Edward County council on whether or not to allow Picton Terminals to operate its commercial port 24 hours a day, if necessary.
Picton Terminals owners asked council for an exemption to a noise bylaw, saying it had to operate at all hours to remain competitive in the business.
However, the citizens group Save Picton Bay has taken county council to court, challenging the zoning on the property that allows the terminal to store salt and the mineral coke.
The hearing is in late October.
County council will delay any decision on hours of operation until that matter is settled.
