The decision to deny rezoning for a condominium development near Presqu’ile Bay is going to cost the Municipality of Brighton some money.
Early in 2023, Brighton council denied JRB Williams Enterprises’ application to build 32 condos on Elgin Street despite its staff recommending the rezoning be approved.
The majority of council believed the development would not fit the existing neighbourhood.
The developer appealed the decision to the Ontario Land Tribunal which ruled against council’s decision allowing the project to go ahead.
And late last month the tribunal ruled that the municipality must pay $20,500 to cover some of the developer’s legal costs, saying the municipality’s denial of the rezoning without offering evidence for its decision was not fair or right.
