Final submissions have been made in the trial regarding a fatal October 2021 crash in Quinte West.
Aysar Younes, who was 23 at the time of the incident, is charged with two counts each of dangerous driving causing death and impaired driving causing death following an investigation into a two-vehicle collision on Old Highway 2 near 8 Wing Trenton.
A 23-year-old Belleville woman and a 22-year-old Quinte West woman were killed in the collision.
Presenting his final submission to Justice Kristin Muszynski, Crown Attorney Mike Lunski outlined the day of the collision and the events leading up to it.
He said a lab at the Kingston Health Sciences Centre was able to take blood from Younes after he was transferred to hospital following the collision.
Based on the blood draw, it was determined that the level was between 110 mg and upwards to 143 mg of alcohol for every 100 millimetres of blood.
The legal limit in Ontario is 80 mg of alcohol for every 100 millimetres of blood.
On the defence’s side, attorney Craig Bottomley said the court should have no faith in the blood analysis, saying there was a complete absence of evidence about how the blood was collected.
He argued that the crown had not established a strong enough case for how the blood was drawn.
In a rebuttal, Lunski said the blood was drawn at the trauma triage stage, based on testimony from one of the witnesses.
Both wrapped up their submissions at the Quinte Courthouse on January 28.
A decision date has been set for March 7, 2025 at 2 p.m.
