The Ontario Land Tribunal has ruled in favour of a developer and reversed a decision by Brighton council to deny a condominium development proposed for Elgin Street East near the Presqu’ile Yacht Club.
Council turned down an application by JRB Williams Enterprises for a rezoning and draft plan of subdivision for a 32-unit condominium spread amongst eight separate townhouse buildings.
Council believed the three-storey and two-storey buildings would not fit in the older neighbourhood which consists of single family homes.
However, the Tribunal rejected that argument saying the proposal fulfilled both the requirements and the spirit of Brighton’s Official Plan and provincial planning policy.
The Tribunal’s decision was made near the end of September.
